The terms and conditions outlined below govern your Account and your use of Services with Felton Creative.

Your contract and account are managed by Stephanie Wilson, trading as Felton Creative Digital Marketing.

By signing up for a Felton Creative service or using the website (our “Services”), you agree to adhere to the following terms and conditions (“Terms of Service”). Any new features or tools added to the current Services will also be subject to the Terms of Service.

Felton Creative reserves the right to update and modify the Terms of Service by posting changes on the website. We recommend that you periodically check the Terms of Service for any updates or changes that may affect you.

User Agreement

In signing up for a plan with Felton Creative “the Software”, you understand, acknowledge and agree that:

(a) The software is continuously evolving, with new features being added all the time.

(b) Felton Creative cannot assure that it is completely immune to unforeseen outcomes, data loss or communication issues, project delays, or any other unpredictable damages or losses.

(c) Felton Creative is under no obligation to add or provide any specific features suggested, implied or tested to the Software;

(d) You bear full responsibility for the upkeep and safeguarding of all data and information that is retrieved, extracted, transformed, loaded, stored, or otherwise processed by the Software.

(e) You will be responsible for all costs and expenses required to backup and restore any data and information that is lost or corrupted as a result of your use of the Software.

(f) You are not locked in to any contract, and you are free to cancel your plan at any time, however there is a cost if you wish to 'transfer' your account to another platform.

1. Account Terms

- You agree to the following terms regarding your account:

- You must be at least 18 years of age or the legal age of majority in your jurisdiction, or have parental or guardian consent to use these Services.

- You are required to provide your full legal name, current address, a valid email address, and any other necessary information to complete the signup process.

- It is your responsibility to ensure that your registration details are accurate, truthful, and complete.

- You acknowledge that Felton Creative will use the email address you provide as the primary means of communication.

- You are responsible for maintaining the security of your password.

- Felton Creative is not liable for any loss or damage resulting from your failure to secure your account and password.

- You are accountable for all activities and content—such as videos, files, data, graphics, photos, and links—uploaded to your account (“Content”).

- Any breach or violation of the Terms of Service, as determined solely by Felton Creative, will lead to an immediate termination of your Services.

Plans and Pricing:

Website Hosting as a sub-account with Felton Creative on Go High Level.

- Starting at $24.99 CAD per month

Our basic plan includes a dashboard that provides access to website hosting, a social media planner, and a chat widget. This pricing is applicable for self-managed sites and does not encompass account management services.

- Starting at $199.00 CAD per month

Our management plan includes a dashboard that provides access to website hosting, a social media planner, and a chat widget. This pricing includes account management services.

- Additional costs for consumables, may include:

• Email sending

• Phone lines and calls

• SMS

• AI-generated content

• AI chat

• Email verification charges

• Other consumables as detailed on our pricing page.

Email Verification Costs

To facilitate users in meeting the email sending requirements effective from February 1, 2024, and to help protect your sending domain, Felton Creative offers an integrated service that verifies the email address of every recipient the first time you send an email to them. Each email address will only be verified once.

This process will minimize the risk of your sending domain being penalized by Email Service Providers (ESPs) or permanently shut down by automatically validating emails and blocking those that fail, which could lead to increased bounce rates, failed deliveries, and spam reports.

There is an additional fee for email verification, priced at USD 0.0035 per email (for $10 USD, you can obtain 2,355 email verifications).

This feature is enabled by default, but users have the option to disable it at any time in their Business Settings. Felton Creative does not take responsibility for the reputation of user domains or for any suspension of your sending domain due to your communication activities. Users are fully accountable for ensuring compliance with all communication regulations and for any consequences arising from non-compliance.

You must read, accept, and agree to all terms and conditions outlined in this Terms of Service agreement, as well as Felton Creative’s Privacy Policy, Cookies Policy, and, if applicable, Data Processing Addendum (“DPA”), which are incorporated by reference, before using the Services or creating a Felton Creative account (“Account”).
